How to evaluate an EOR for Guatemala
Check these before you commit.
- Who employs your hire. Article 81 makes the company receiving supplied workers' services responsible to them. Ask which Guatemalan company signs the contract and how it keeps statutory payments current.
- The aguinaldo and Bono 14. Each is worth a month of ordinary salary for a full year. The aguinaldo is paid half between 1 and 15 December and half between 1 and 15 January. Ask for both as monthly accruals.
- The IGSS contribution. 10.67% from the employer and 4.83% from the employee. Ask the provider to confirm the rates for the payroll year and any other levies on the invoice.
- The trial period. The first two months of an indefinite contract, during which either side can end it without liability.
- Exit cost. After the trial period, an unjustified dismissal costs a month of salary per year of service, on the average salary of the last six months.
