How do we evaluate EOR providers?
We ranked each provider on what decides a Salvadoran hire: which company employs your hire and on what contract, whether the pension and ISSS contributions, the aguinaldo and the vacation premium are shown in the quote, how clearly the exit cost under article 58 of the Labour Code is explained, and pricing.
Hiring in El Salvador means a pension contribution of 8.75% from the employer, a separate ISSS health contribution, an aguinaldo each December and a vacation premium, on top of salary. Setting up your own company means running the pension and ISSS filings and the written contract process yourself. Hiring a contractor is faster, but the Labour Code defines employment by the work done under your direction for a salary, whatever the contract is called, and treats permanent work as indefinite employment.
How to evaluate an EOR for El Salvador
Check these before you commit.
- Who employs your hire. The Code treats a contractor that employs staff as their employer and makes contractor and subcontractor jointly liable. Ask which Salvadoran company signs the contract.
- The aguinaldo and vacation premium. At least 15 days of pay for one to three years of service, 19 for three to ten, 21 from ten, paid between 12 and 20 December; vacation pay carries a 30% premium. Ask for both as monthly accruals.
- The written contract. The contract is written in three copies, one sent to the Dirección General de Trabajo within eight days of signing.
- Exit cost. A dismissal without just cause costs 30 days of basic salary per year of service, never less than 15 days, with the daily salary capped at four times the daily minimum wage.
- Contributions. The pension is 8.75% employer and 7.25% employee; the ISSS health contribution is separate. Ask the provider to show both on the quote.
