How do we evaluate EOR providers?
We ranked each provider on what decides an Ecuadorian hire: which company employs your hire and how the arrangement fits the ban on labour intermediation, whether the IESS contribution, the thirteenth and fourteenth salaries and the reserve fund are shown in the quote, how clearly the exit cost is explained, and pricing.
Hiring in Ecuador means an 11.15% IESS contribution, two extra salaries and, from the second year, a reserve fund, on top of salary. On a $1,000 monthly salary that is $1,235 a month in the first year and $1,318.33 from the second, before the provider fee. Setting up your own company means running the IESS filings and payroll yourself. Hiring a contractor for someone who works inside your team is the arrangement the ban on intermediation and precarious employment is aimed at.
How to evaluate an EOR for Ecuador
Check these before you commit.
- The legal basis. Ask which Ecuadorian company employs your hire and how the arrangement fits the ban on labour intermediation described in the Labour Code's note on Mandate 8.
- The thirteenth and fourteenth salaries. Paid monthly, or as lump sums on the employee's written request: the thirteenth by 24 December, the fourteenth by 15 March on the Coast and in Galápagos or by 15 August in the Sierra and the Amazon.
- The reserve fund. One month of pay per year of service after the first. Ask how it appears in the quote from month 13.
- The profit share. Employers share 15% of net profits with employees. With an EOR it is the provider's company's profit, so ask how it is handled.
- Exit cost. A dismissal without legal grounds costs three months of pay for up to three years of service, then a month per year up to 25, plus a desahucio bonus of 25% of monthly pay per year.
